Terms of Service for AscendiStat
AscendisMed International Emergency Medical Services
1. Acceptance of Terms
By downloading, installing, or using the AscendiStat mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
AscendiStat is a mobile platform that provides:
- Emergency Medical Services: Ambulance dispatch and emergency response coordination
- Telemedicine Services: Video and chat consultations with licensed healthcare providers
- Medical Records Management: Secure storage and access to your medical information
- Healthcare Provider Network: Access to verified medical professionals and facilities
- Payment Processing: Secure payment for medical services and subscriptions
3. Eligibility and Account Registration
3.1 Age Requirements
- You must be at least 18 years old to create an account
- Users under 18 may use the service with parental consent and supervision
- Emergency services are available to users of all ages
3.2 Account Information
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account
- You must notify us immediately of any unauthorized use
- Medical information must be accurate for proper care delivery
4. Medical Services and Limitations
4.1 Emergency Services
- Our emergency dispatch service connects you with local ambulance providers
- Response times may vary based on location and availability
- We do not guarantee specific response times
- For immediate life-threatening emergencies, call local emergency services directly
4.2 Telemedicine Services
- Consultations are provided by licensed healthcare professionals
- Telemedicine has limitations and may not be suitable for all conditions
- Healthcare providers may recommend in-person evaluation when necessary
- Prescriptions are subject to local laws and provider discretion
4.3 Medical Disclaimers
- The App does not provide medical diagnosis or treatment
- Information provided is for educational purposes only
- Always consult with qualified healthcare providers for medical decisions
- The App is not a substitute for professional medical care
- We do not guarantee the accuracy of medical information provided by third parties
5. User Responsibilities
5.1 Appropriate Use
- Use the App only for legitimate medical and emergency purposes
- Provide accurate medical information to healthcare providers
- Follow healthcare provider instructions and recommendations
- Respect the privacy and confidentiality of other users
5.2 Prohibited Activities
- Making false emergency requests
- Providing false or misleading medical information
- Attempting to hack, disrupt, or compromise the App's security
- Using the App for illegal activities
- Sharing your account credentials with others
- Attempting to impersonate healthcare providers
6. Payment Terms
6.1 Fees and Charges
- Emergency services may incur charges based on local ambulance rates
- Telemedicine consultations are charged per session or through subscription plans
- Subscription plans provide access to premium features and services
- All fees are clearly displayed before service confirmation
6.2 Payment Processing
- Payments are processed through secure third-party providers (Stripe)
- You authorize us to charge your selected payment method
- Failed payments may result in service suspension
- You are responsible for keeping payment information current
6.3 Refunds and Cancellations
- Emergency service fees are generally non-refundable once services are dispatched
- Telemedicine consultation refunds are subject to provider policies
- Subscription cancellations take effect at the end of the current billing period
- Refund requests must be submitted within 30 days of service
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
8. Intellectual Property
8.1 Our Rights
- The App and its content are protected by copyright, trademark, and other intellectual property laws
- You may not copy, modify, distribute, or create derivative works
- All trademarks and service marks are the property of their respective owners
8.2 User Content
- You retain ownership of your medical information and personal data
- You grant us a license to use your information to provide services
- You are responsible for the accuracy of information you provide
9. Limitation of Liability
9.1 Service Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We do not guarantee uninterrupted or error-free service
- We are not liable for delays in emergency response
- We are not responsible for the quality of third-party medical services
- We do not guarantee specific medical outcomes
9.2 Damages Limitation
Our total liability to you for any damages shall not exceed the amount you paid for services in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless AscendiStat, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any false or misleading information you provide
11. Service Availability
11.1 Geographic Limitations
- Services are currently available in Uganda and select regions
- Emergency services depend on local ambulance provider availability
- Telemedicine services may be limited by healthcare provider licensing
11.2 Technical Requirements
- Requires compatible mobile device and internet connection
- Location services must be enabled for emergency features
- We may update technical requirements with notice
12. Modifications to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Sending email notification to your registered address
- Displaying a prominent notice in the App
Continued use of the App after changes constitutes acceptance of the new Terms.
13. Termination
13.1 Termination by You
- You may terminate your account at any time
- Termination does not relieve you of payment obligations
- Some information may be retained as required by law
13.2 Termination by Us
We may terminate or suspend your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activities
- Fail to pay required fees
- Misuse emergency services
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Uganda, without regard to conflict of law principles.
14.2 Dispute Resolution Process
- Direct Communication: Contact us first to resolve disputes informally
- Mediation: If informal resolution fails, disputes will be resolved through mediation
- Arbitration: Unresolved disputes will be settled through binding arbitration
- Class Action Waiver: You waive the right to participate in class action lawsuits
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. Emergency Procedures
In Case of Emergency:
- Life-threatening emergencies: Call local emergency services immediately (911, 999, 112)
- Non-life-threatening emergencies: Use the AscendiStat emergency feature
- Technical issues during emergency: Call our emergency hotline: +256-700-000-000
- App malfunction: Use alternative emergency contact methods
